Last updated: 28 September 2026
1. General Provisions
These Terms and Conditions set out the rules governing the purchase and use of paid access to a digital channel operated by the Seller, through which educational materials, instructions, prompts, examples, publications, recordings, files, and other digital content are made available.
The Seller is:
Yanina Klemez
conducting business activity at:
Fort Wola 12C/57
01-258 Warsaw
Poland
NIP: 9512538612
REGON: 521704172
E-mail: kreatywnalab@gmail.com
hereinafter referred to as the “Seller”.
A person purchasing access to the paid channel is hereinafter referred to as the “Customer”.
These Terms and Conditions are made available to the Customer before placing an order in a manner that allows them to be saved and reproduced.
Placing an order means that the Customer has read and accepted these Terms and Conditions.
2. Nature of the Product
The subject of the sale is one-time paid, indefinite access to the paid digital channel and the materials made available through it.
Depending on the current content, the channel may include in particular:
  • educational materials,
  • instructions and tutorials,
  • prompts,
  • examples of the use of artificial intelligence-based tools,
  • graphic materials,
  • video or audio recordings,
  • PDF files and other digital materials,
  • information concerning tools and working methods,
  • practical examples,
  • new publications and materials added by the Seller.
The exact scope of the offer and the price are specified on the sales page or in another communication presented to the Customer before purchase.
The purchase of access does not constitute a subscription and does not involve recurring payments unless a particular offer expressly states otherwise.
Unless expressly stated otherwise in the offer, the purchase does not include individual consultations, mentoring, individual feedback, or preparation of materials commissioned by the Customer.
3. Conclusion of the Contract and Payment
Access to the channel may be purchased through the website, a payment page, or another sales channel specified by the Seller.
The conditions for processing an order are:
  • providing the information required during the purchase process,
  • accepting these Terms and Conditions,
  • providing any required consents or declarations where necessary due to the nature of the product,
  • making full payment of the price.
The contract for the supply of digital content and access to the paid channel is concluded between the Seller and the Customer once the order has been successfully placed and payment has been made, following prior acceptance of these Terms and Conditions and submission of the required declarations and consents.
Once the payment has been received or confirmed, the Customer receives the information required to access the channel.
The Customer is responsible for providing accurate information, in particular their e-mail address and any other information required to grant access.
4. Indefinite Access
Access to the paid channel is granted on a one-time basis and without a fixed time limit.
This means that, after making the required payment, the Customer is not required to pay a monthly or annual subscription fee in order to continue using the purchased access, unless a particular offer expressly provides for a different model.
Access remains active indefinitely, subject to the cases specified in these Terms and Conditions.
The term “indefinite access” means access for as long as the channel remains operational and it is technically possible for the Seller to provide access to it. It does not constitute a guarantee that a particular external platform or application will continue to exist indefinitely.
The Seller may change the platform through which the channel is provided if justified by technical, organizational, security-related reasons, or changes made by an external provider.
Where reasonably possible, the Seller will inform Customers of material changes concerning the method of access.
5. Leaving the Channel and Loss of Access Due to Reasons Attributable to the Customer
The Customer may stop using the channel at any time.
If the Customer:
  • voluntarily leaves the channel,
  • deletes their account on the platform,
  • loses access to their own account,
  • deletes the application,
  • changes their account details in a way that makes identification impossible,
  • blocks or restricts the operation of their own account,
  • or loses the ability to use the provided channel for other reasons attributable to them,
such circumstances do not in themselves constitute grounds for a refund.
The Seller does not guarantee restoration of access where the Customer voluntarily leaves the channel or loses access for reasons attributable to the Customer.
If restoration of access is technically possible, the Seller may, at their own discretion, allow the Customer to rejoin after verification of the previous purchase.
The provisions of this section do not limit any mandatory consumer rights arising from applicable law.
6. Rules for Using the Channel
The purchased access is individual and intended exclusively for the Customer who made the purchase.
The Customer may not:
  • share the access link with third parties,
  • provide information enabling third parties to access the channel,
  • allow other persons to use the channel,
  • copy all or a substantial part of the materials for further distribution,
  • resell access or materials,
  • sublicense the materials,
  • publish paid materials in other channels, groups, websites, or social media,
  • create and distribute copies of the channel or its materials database,
  • use the materials to create a competing product by copying their content.
If there is reasonable suspicion that access has been shared with third parties or that materials are being distributed without authorization, the Seller may temporarily suspend access in order to clarify the situation.
In the event of a material or repeated breach of these Terms and Conditions, the Seller may block the Customer’s access to the channel.
The above does not deprive the Customer of any rights arising from mandatory provisions of law.
7. Copyright
All materials made available in the paid channel, including in particular:
  • texts,
  • recordings,
  • graphics,
  • instructions,
  • prompts,
  • PDFs,
  • presentations,
  • examples,
  • workflows,
  • studies and other materials,
are protected by copyright or other intellectual property rights unless expressly stated otherwise.
Purchasing access does not transfer copyright to the Customer.
The Customer receives a non-exclusive, non-transferable right to use the materials for their own personal or professional purposes, in accordance with the intended use of each material.
The Customer may use the knowledge, methods, and skills acquired in their own business activities and projects.
However, copying and reselling the Seller’s materials or providing them to third parties as the Customer’s own product is not permitted.
8. Educational Nature and No Guarantee of Results
The materials provided in the channel are educational and informational in nature.
The Seller does not guarantee that use of the materials will result in:
  • acquiring clients,
  • achieving a specific income,
  • increasing sales,
  • increasing the number of followers or reach,
  • receiving orders or commissions,
  • obtaining employment,
  • achieving a specific professional result,
  • achieving specific financial or business results.
Results depend on many factors beyond the Seller’s control, including the Customer’s level of involvement, experience, method of implementing the information, market conditions, tools used, and individual actions.
Failure to achieve an expected business or professional result does not in itself mean that the digital product is not in conformity with the contract.
9. Artificial Intelligence Tools and External Services
The channel may contain information and materials relating to artificial intelligence tools and other products and services provided by independent third parties.
External providers may change at any time, in particular:
  • tool functionality,
  • how specific features operate,
  • appearance and interface,
  • usage limits,
  • prices,
  • subscription plans,
  • terms of use,
  • availability of individual features.
They may also discontinue a particular tool or feature entirely.
The Seller has no control over such changes.
Some tools discussed in the channel may require the Customer to have their own account or purchase a separate paid subscription.
The cost of such external tools is not included in the price of access to the channel unless the offer expressly states otherwise.
The Seller is not a party to any agreement between the Customer and the external provider of a particular tool.
10. Updates and New Materials
The Seller may add new content, updates, and additional materials to the channel.
However, indefinite access does not mean that the Seller is obliged to:
  • publish new materials at a specified frequency,
  • create new materials without any time limit,
  • update every previously published material,
  • adapt the materials after every change made to external tools,
  • provide a specified number of new publications per month or year,
unless such an obligation has been expressly stated in a particular offer.
Additional materials may be published at the Seller’s discretion.
The above does not limit the Seller’s obligations concerning the conformity of digital content or digital services with the contract under applicable law.
11. Right of Withdrawal
A Customer who is a consumer and enters into a distance contract generally has a statutory right to withdraw from the contract within 14 days, subject to exceptions provided for by applicable law.
In the case of paid digital content not supplied on a tangible medium, the right of withdrawal may be lost once the supply of the digital content has begun, provided that all conditions required by law have been met.
If the Customer wishes to obtain access to the digital content immediately after purchase, before the supply begins, the Seller may require the Customer to:
  • give explicit prior consent to begin supplying the digital content before the expiry of the 14-day withdrawal period,
  • confirm that the Customer acknowledges that, once the service begins under the conditions specified by law, they will lose the right of withdrawal.
The Seller provides the Customer, on a durable medium, with the confirmation of the conclusion of the contract and the declarations made, as required by law.
If all legally required conditions have been met and the supply of digital content has begun, the Customer loses the right of withdrawal to the extent provided for by applicable law.
If the conditions for losing the right of withdrawal have not been effectively met, the Customer’s rights under applicable consumer law remain unaffected.
If the Customer is entitled to withdraw from the contract, a withdrawal statement may be sent to:
kreatywnalab@gmail.com
12. Refunds
Once the supply of digital content has effectively begun and the Customer has lost the statutory right of withdrawal, the Seller does not provide voluntary refunds of the purchase price.
In particular, the following do not constitute grounds for a refund:
  • the Customer changing their mind after purchase,
  • lack of time,
  • lack of activity,
  • failure to use the materials,
  • failure to review the materials,
  • voluntarily leaving the channel,
  • deletion of the Customer’s own account,
  • discontinuing use of the platform,
  • loss of access as a result of the Customer’s own actions,
  • failure to achieve expected financial, business, or professional results.
The above does not limit the Customer’s right to submit a complaint, withdraw from the contract where such a right still applies, or exercise any other rights arising from mandatory provisions of law.
13. Complaints
The Seller is responsible for supplying digital content and services in conformity with the contract to the extent required by applicable law.
The Customer may submit a complaint in particular if:
  • they did not receive the purchased access,
  • access does not function properly,
  • there is a technical issue preventing use of the purchased service,
  • the supplied digital content or digital service is not in conformity with the contract.
Complaints should be sent to:
kreatywnalab@gmail.com
Where possible, the complaint should include:
  • the Customer’s full name,
  • the e-mail address used for the purchase,
  • information allowing the order to be identified,
  • a description of the issue,
  • information about the expected method of resolving the matter.
The Seller handles complaints in accordance with applicable law.
If additional information is required in order to process a complaint, the Seller may ask the Customer to provide it.
14. Technical Requirements
To use the channel, the Customer must have:
  • a device with Internet access,
  • up-to-date software allowing use of the platform,
  • an active e-mail address,
  • an active account in the application or service through which the channel is provided, if such an account is required.
The Customer is responsible for ensuring the proper functioning of their own device and Internet connection.
The Seller is not responsible for problems resulting solely from:
  • failure of the Customer’s device,
  • problems with the Customer’s Internet connection,
  • outdated software used by the Customer,
  • deletion or blocking of the Customer’s account by an external provider due to the Customer’s violation of that platform’s rules, unless applicable law provides otherwise.
15. External Platform
The channel may be operated through an external application or platform.
The external platform is an independent service provider and may have its own terms and conditions, privacy policy, and rules of use.
The Seller does not have full control over the operation of the external platform and is not responsible for global outages, discontinuation of its operations, or technical changes beyond the Seller’s control.
If use of the current platform becomes impossible or excessively difficult, the Seller may transfer the channel or its materials to another platform and provide Customers with an appropriate means of continued access, where technically and organizationally possible.
16. Personal Data
Customers’ personal data is processed in accordance with applicable law and the Seller’s Privacy Policy.
The Privacy Policy is available at:

Yanina Klemez

17. Customer Materials and Work
The Customer retains the rights to their own materials, graphics, photographs, projects, videos, and other works created by them.
The purchase of access to the channel does not in itself constitute consent for the Seller to use the Customer’s work in advertisements, promotional materials, or social media.
If the Seller wishes to use a specific Customer work, review, result, image, or other material allowing the Customer to be identified, the Seller will obtain separate consent or another appropriate legal basis where required.
18. Customer Responsibility
The Customer agrees to use the channel in accordance with:
  • these Terms and Conditions,
  • applicable law,
  • generally accepted standards of conduct,
  • the rules of the platform on which the channel is hosted.
The Customer is responsible for their own decisions and actions taken on the basis of knowledge obtained from the educational materials.
The Seller does not provide individual legal, tax, financial, or other professional advisory services through the channel unless a particular offer expressly states otherwise.
19. Changes to the Terms and Conditions
The Seller may amend these Terms and Conditions for justified reasons, including in particular:
  • changes in applicable law,
  • changes in the method of providing the service,
  • changes to the platform used,
  • technical changes,
  • the need to improve security,
  • expansion or modification of the channel’s functionality.
Changes to the Terms and Conditions do not deprive Customers of rights acquired before such changes were introduced.
To the extent required by laws relating to digital content and digital services, changes affecting ongoing contractual relationships will be made in accordance with the conditions provided for by applicable law.
20. Final Provisions
These Terms and Conditions and contracts concluded under them are governed by Polish law, subject to mandatory provisions protecting consumers.
No provision of these Terms and Conditions is intended to limit or exclude rights that cannot be waived or taken away from a consumer under applicable law.
In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law and European Union law shall apply.
These Terms and Conditions are made available to the Customer electronically in a manner that allows them to be saved, stored, and reproduced.
